Guest Wi-Fi Terms of Service

Introduction
These Terms of Service ("Terms") govern your access to and use of the free Wi-Fi service ("Service") provided by Pixelflow LDA ("we," "us," or the "Provider") at our premises. By clicking “I Accept” or by accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

1. Privacy Policy (GDPR Compliance)
1.1. Data Processing: The Service is provided on our behalf by Plume Design Inc. ("Plume"), which processes your personal data to enable access to the Service. Personal data may include your email address, phone number, or other identifiers provided during authentication, as well as technical data (e.g., IP address, MAC address, browser type, and usage details).
1.2. Purpose and Legal Basis: We process personal data to:
  • Authenticate Users and provide the Service (based on your consent or contract performance).
  • Ensure network security and prevent misuse (based on our legitimate interests).
  • Optimize the Service and conduct anonymized analytics (based on our legitimate interests, where not overridden by your rights).
  • Send marketing communications, where you have provided explicit consent (per the ePrivacy Directive).
  • 1.3. Data Retention: Personal data is retained only for as long as necessary to provide the Service or as required by law (e.g., up to 12 months for technical logs, unless otherwise mandated).
  • 1.4. Your Rights: Under GDPR, you have the right to:
  • Access, rectify, or erase your personal data.

  • Withdraw consent at any time (without affecting prior processing).

2. Registration and Security
2.1. To access the Service, you may need to authenticate via an email address, phone number, or social media account, or complete a registration form.
2.2. You agree to provide accurate, current, and complete information as requested.
2.3. If you create a username or password, you are responsible for keeping them confidential and secure. You are liable for any activity under your credentials.
2.4. Notify us immediately at recompensas@cafeexpo.pt if you suspect unauthorized use of your account.
3. Code of Conduct
3.1. You agree to use the Service in compliance with all applicable EU laws and regulations, including data protection and cybersecurity laws.
3.2. You must not:
  • Upload or transmit content that is unlawful, harmful, abusive, defamatory, obscene, or invasive of another’s privacy.
  • Send unsolicited communications (e.g., spam, junk mail, or chain letters) without recipient consent, per the ePrivacy Directive.
  • Distribute viruses, malware, or other harmful software.
  • Violate third-party rights, including intellectual property or privacy rights.
  • Collect or store personal data of other Users without their consent.
  • Manipulate identifiers (e.g., IP or MAC addresses) to disguise the origin of transmissions.
  • Attempt unauthorized access to the Service, our systems, or other networks.
  • Interfere with or disrupt the Service or exceed any bandwidth limits.
  • Sell or transfer access to the Service.
4. Third-Party Websites
4.1. The Service may provide access to third-party websites, which are governed by their own terms and privacy policies.
4.2. We are not responsible for the content, security, or practices of third-party websites. Review their terms and policies before use.
5. Disclaimer and Limitation of Liability
5.1. The Service is provided “as is” without warranties, to the extent permitted by EU law. We do not guarantee:
  • Uninterrupted or error-free access.
  • Freedom from viruses or harmful components.
  • Suitability for your specific requirements.
  • 5.2. To the fullest extent permitted by EU law, we (including Plume and our affiliates, officers, employees, and agents) are not liable for:
  • Indirect, incidental, or consequential damages arising from the use or inability to use the Service.
  • Losses caused by third-party content, software, or services accessed via the Service.
  • Damage due to improper configuration of your device.
  • 5.3. Our aggregate liability for claims arising from these Terms or the Service is limited to €50, except where EU consumer protection laws prohibit such a limitation.
  • 5.4. Nothing in these Terms excludes liability for damages that cannot be limited under EU law (e.g., for gross negligence or willful misconduct).
6. Indemnity
6.1. To the extent permitted by EU law, you agree to indemnify and defend us (including our affiliates, officers, employees, and agents) against claims, liabilities, damages, or expenses (including reasonable legal fees) arising from:
  • Your misuse or unauthorized use of the Service.
  • Your violation of these Terms or applicable laws.
  • Your infringement of third-party rights (e.g., intellectual property or privacy).
  • Disputes between you and third parties.
  • 6.2. We reserve the right to assume control of any matter subject to indemnification, and you agree to cooperate with our defense.
7. Changes and Termination
7.1. We may modify, suspend, or discontinue the Service (or any part thereof) at any time without notice, where permitted by law.
7.2. We may restrict or prioritize bandwidth, block certain content, or limit access to protect the Service or other Users.
7.3. We may update these Terms at any time. Updated Terms will be provided when you log in or published at https://getwifi.pt/privacy/pixelflow . Continued use of the Service constitutes acceptance of the updated Terms.
7.4. If you are dissatisfied with the Service or these Terms, your sole remedy is to stop using the Service.
8. Governing Law and Jurisdiction
8.1. These Terms are governed by the laws of Portugal, where Pixelflow LDA is established, without prejudice to mandatory consumer protection laws in your country of residence.
8.2. Disputes arising from these Terms will be resolved in the courts of Portugal, subject to applicable EU consumer protection laws.
8.3. If any provision of these Terms is found to be unlawful or unenforceable, it will be severed without affecting the remaining provisions.

9.1. Notices, including updates to these Terms, may be provided via email, regular mail.
9.2. You consent to receiving electronic communications related to the Service.
